The operator assumes no liability for damages, consequential damages or failures resulting in particular from:
- incorrect or improper flashing/programming (e.g. interruption, wrong sequence, incorrect settings),
- missing or insufficient power supply (e.g. no charger/support charger, voltage drop, battery problems),
- use of unsuitable, non-original, unlicensed or incompatible flash tools/interfaces/cables,
- insufficient preparation (e.g. missing backups/readouts, missing original data/original software, incorrect ECU identification),
- hardware/ECU defects, worn components or pre-existing vehicle damage,
- changes to the vehicle/ECU by third parties or previous third-party software/modifications,
- operating errors, lack of expertise or failure to comply with manufacturer/tool requirements.
Installing (flashing/programming) software is carried out at the sole responsibility of the user or the executing person/workshop. The user is responsible for ensuring the technical suitability, safe procedure (including voltage stabilization) and compatibility of the tools used before the flashing process.
Liability for Data Loss / Restoration
No liability is assumed for data loss (e.g. missing backup, damaged original data) or for costs of diagnostics, restoration, towing, spare parts or workshop work, unless mandatory statutory provisions provide otherwise.
