Terms for digital content and software files.
Digital Content / Software Files
The products offered consist exclusively of digital content (software files) that are not supplied on a physical data carrier.
All software files are intended exclusively for racing, motorsport, testing or development purposes. Use on public roads is expressly prohibited. The software has no approval, authorization or clearance for road use.
Exclusion of the Right of Withdrawal
For digital content, the right of withdrawal expires in accordance with § 356 para. 5 BGB as soon as the customer has expressly agreed that execution of the contract will begin before the withdrawal period expires and has acknowledged that they thereby lose their right of withdrawal.
Consent is given actively by ticking a checkbox before purchasing or downloading the digital content.
Comprehensive Disclaimer
The use of the software files offered is entirely at the user’s own risk. The operator assumes no liability whatsoever for damages or consequential damages of any kind.
In particular, no liability is assumed for:
- direct or indirect damage to the vehicle, engine, transmission or control units,
- software errors, malfunctions or incompatibilities,
- incorrect, incomplete or improper flashing/programming,
- missing or insufficient power supply (e.g. no charger or support charger),
- use of non-original, unlicensed, unsuitable or incompatible flashing tools,
- data loss, missing or damaged backups,
- consequential costs such as towing, diagnostics, repairs, spare parts or workshop costs,
- loss of profit, loss of use or other financial losses,
- loss of operating permit or insurance coverage.
No warranty, guarantee or assurance is expressly given regarding function, compatibility, performance increase, durability or suitability for a particular purpose.
The user bears full responsibility for the selection, use, application and legal permissibility of using the software.
Consent Through Download / Use
By purchasing, downloading or using the digital content, the customer confirms that they have read, understood and accepted the notices, the disclaimer and the exclusion of the right of withdrawal.
The customer also declares that they will use the software files exclusively within the legally permissible framework and refrain from any use on public roads.
